Owner & Operator: Henry Jason, operating as a sole proprietor (“I,” “me,” “my”). Customer: Any individual or entity purchasing or using my products (“you,” “your”). Location: Michigan, USA.

These Terms constitute a legally binding agreement between you and Henry Jason.

1. Acceptance of Terms

You must be at least 18 years old to use this Site or purchase Products. You agree not to misuse the Site, attempt unauthorized access, or engage in any activity that disrupts its operation.

By accessing my website, purchasing my products, or using any services I provide, you agree to be bound by these Terms of Use. If you do not agree, you may not purchase or use my products.

By using this Site, you represent that you have the legal capacity to enter into a binding contract.

2. Product Information & General Disclaimer

My products are handcrafted or individually finished using metals, minerals, coatings, and specialty materials. Natural variations in color, pattern, texture, oxide finishes, and appearance are normal and expected.

Product descriptions, photos, and specifications are provided for general informational purposes only. Colors and finishes may appear differently due to lighting, screen differences, or natural material variation.

Nothing on my website or in my listings guarantees performance, durability, or suitability for any specific purpose.

Products are decorative accessories only and are not intended for medical, protective, or safety-critical use.

3. Limitation of Liability

To the fullest extent permitted under Michigan law:

I am not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of income, loss of data, emotional distress, or property damage.

My total liability for any claim related to a purchase is strictly limited to the amount you paid for the product.

Your sole and exclusive remedy for any dispute or claim shall be repair, replacement, or refund of the product, at my discretion.

You agree that you purchase, use, and handle my products at your own risk.

This includes harm resulting from:

- Misuse, improper handling, or modification

- Allergic reactions or skin sensitivities

- Exposure to chemicals, moisture, or extreme conditions

- Dropping, bending, or impact damage

- Normal wear and tear

4. Pricing, Orders & Availability

Prices may change at any time without notice. I reserve the right to refuse or cancel any order for any reason, including suspected fraud or incorrect pricing.

If an order is canceled after payment, you will receive a full refund.

You agree to provide accurate billing and shipping information.

I reserve the right to limit quantities, discontinue products, or correct typographical, pricing, or listing errors at any time.

Payment must be successfully processed before an order is accepted and fulfilled.

5. Privacy & Data Use

6. Product Warnings, Care, Use, and Safety

Safety Warnings

Jewelry should not be worn if it may interfere with medical devices; consult a qualified medical professional if you have concerns.
Rings should be removed during heavy lifting, manual labor, sports, or impact-prone activities.

Improper use, unsafe handling, modification, or failure to follow these warnings may result in injury or damage, for which you assume all associated risks.

Material and Finish Characteristics

You acknowledge that:

Jewelry and accessories may contain edges, textures, or finishes requiring careful handling.
Some materials may react to chemicals, moisture, or impact.
Oxide finishes are delicate and naturally change over time as part of normal wear.

Normal wear, environmental exposure, and natural material behavior are not defects.

7. Shipping, Loss, and Damage

Title and risk of loss pass to you upon delivery to the carrier to the extent permitted by applicable law.

I am not responsible for:

- Carrier delays

- Lost or stolen packages

- Incorrect addresses provided by the customer

- Customs delays or fees for international orders

- Damage occurring during transit unless insured shipping was purchased and approved by the carrier

Delivery dates are estimates only and are not guaranteed.

8. Returns, Exchanges, and Cancellations

All return, exchange, and cancellation policies are posted on my website. By purchasing, you agree to those policies.

Custom, or personalized items may be non-returnable.

9. Intellectual Property

All product designs, photos, branding, descriptions, and written content are the intellectual property of Henry Jason. You may not copy, reproduce, modify, distribute, or use any content without my written permission.

I grant you a limited, non-exclusive, revocable license to access and use the Site solely for personal, non-commercial purposes.

10. Prohibited Conduct

You agree not to:

11. Warranty Disclaimer

- Damage caused by chemicals, abrasion, impact, or misuse

- Epoxy clouding or yellowing

- Natural variations in patterning or oxidation

- Normal wear and tear

Except for the limited manufacturing-defect warranty described above, all other warranties—express or implied—are disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.

No statement made by me—verbally, in writing, or through marketing—creates any warranty beyond the limited warranty described.

12. Indemnification

You agree to indemnify and hold harmless Henry Jason, to the fullest extent permitted by law, from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

- Your misuse of the products

- Your violation of these Terms

- Your breach of any applicable laws

- Any claims brought by third parties related to your use of the products

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any dispute arising from these Terms, your purchase, or your use of my products shall be resolved exclusively in the state or federal courts located in Macomb County, Michigan, and you consent to that jurisdiction.

14. Force Majeure

I am not liable for failure or delay in performance caused by events beyond my reasonable control, including but not limited to natural disasters, supply shortages, labor disruptions, carrier interruptions, governmental actions, illness, or technical failures.

15. Severability

If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

16. Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that or any other provision.

17. Entire Agreement

These Terms, together with any posted policies referenced herein, constitute the entire agreement between you and me regarding use of the Site and purchase of Products and supersede any prior communications or understandings.

18. Changes to Terms

I may update or modify these Terms at any time. Continued use or purchase after changes are posted constitutes acceptance of the updated Terms.

Where required by law, reasonable notice of material changes will be provided.
